Trial and Appellate Co-Counsel & Strategic Advisory

Justice David B. Saxe (Ret.) serves as co-counsel and strategic advisor to law firms handling complex litigation in New York courts at both the trial and appellate levels on appeals to the New York Appellate Division and Court of Appeals. Drawing on more than three decades of service on the New York Judiciary—including nearly two decades on the Appellate Division, First Department—he provides insight into how courts evaluate arguments, assess credibility, and frame decisions.

Whether he is retained at the outset of a matter, during motion practice, or in connection with an appeal, Judge Saxe assists counsel in refining legal theories, identifying potential vulnerabilities, anticipating judicial concerns, shaping persuasive written submissions and preparing for argument. He regularly advises lawyers on complex matters pending before the Commercial Division of the New York State Supreme Court, New York County, where early strategic guidance informed by judicial perspective can be particularly valuable. His role is collaborative and discreet, designed to enhance counsel’s effectiveness while preserving the primary client relationship.
